1. ACCEPTANCE OF OFFICIAL RULES
1.A. By participating in the Promotion, each entrant agrees to be bound by these Official Rules and by Sponsor’s decisions, which are final and binding in all respects.
1.B. The Promotion is a sweepstakes.
1.B.i. No purchase is necessary to enter or win.
1.B.ii. A purchase will not improve chances of winning.
1.B.iii. The Promotion is void where prohibited by law.
1.B.iv. The Promotion is not a lottery, gambling activity, or wagering scheme, and is conducted in compliance with applicable sweepstakes laws and regulations.
2. PROMOTION OVERVIEW
2.A. The Promotion may be conducted as a single promotional round or as multiple sequential promotional rounds.
2.B. Each promotional round is referred to as a “Round.”
2.C. Each Round is associated with a designated vehicle and a defined entry period.
3. PROMOTION PERIOD
3.A. Each Round has a defined start date and end date (“Promotion Period”).
3.B. Promotion Period dates will be publicly disclosed on Sponsor’s website prior to the start of each Round.
3.C. Sponsor reserves the right to schedule, modify, extend, or discontinue Rounds at its sole discretion, subject to applicable law.
4. ELIGIBILITY
4.A. The Promotion is open only to legal residents of the Eligible Jurisdictions.
4.B. Entrants must be at least eighteen (18) years of age or the age of majority in their state of residence, whichever is greater, at the time of entry.
4.C. Employees, officers, directors, agents, and representatives of Sponsor, and members of their immediate family or household, are not eligible.
4.D. State Registration Compliance: The Promotion is conducted in compliance with applicable federal and state sweepstakes laws. Where required, the Promotion is registered or bonded in accordance with applicable law. Participation in the Promotion is void in jurisdictions where registration, bonding, or other legal requirements are not satisfied.
5. HOW TO ENTER
5.A. Merchandise-Associated Entry Method (Optional)
5.A.i. Eligible participants may receive sweepstakes entries by purchasing Sponsor’s merchandise through the official Website during an active Round.
5.A.ii. Each merchandise item or promotional offer may include a designated number of sweepstakes entries, which will be disclosed on the Website at the time of purchase.
5.A.iii. Sweepstakes entries associated with merchandise purchases are promotional in nature and are not based on a per-dollar, per-unit-of-currency, or ticket-based calculation.
5.A.iv. Purchases must originate from an Eligible Jurisdiction to generate sweepstakes entries.
5.A.v. Purchases from non-eligible jurisdictions do not generate sweepstakes entries and do not fund any prize.
5.A.vi. Merchandise purchases do not represent ownership, equity, investment interest, or enhanced odds beyond the number of entries expressly associated with the applicable merchandise item or offer.
5.B. Alternate Method of Entry (AMOE)
5.B.i. No purchase is necessary to enter or win.
5.B.ii. Eligible participants may enter the Promotion by submitting the designated online entry form available on Sponsor’s Website during an active Round.
5.B.iii. Limit one (1) free entry per person per week per Round.
5.B.iv. Free entries require the same participant information as merchandise-associated entries.
5.B.v. Free entries have the same odds of winning per entry as merchandise-associated entries.
5.B.vi. Automated, duplicate, incomplete, inaccurate, or fraudulent entries are void.
6. ENTRY CONDITIONS
6.A. All entries must be received during the applicable Promotion Period.
6.B. Entries are non-transferable.
6.C. Entries have no cash value outside the Promotion.
6.D. Sponsor reserves the right to verify eligibility, identity, and entry validity.
6.E. Sponsor reserves the right to impose reasonable entry caps, technical limits, or safeguards to protect the integrity of the Promotion.
6.F. Sponsor reserves the right to refuse, suspend, disqualify, or void any entry if Sponsor reasonably believes such entry compromises the fairness, security, or integrity of the Promotion.
6.G. Maximum Entries Per Round
6.G.i. Each participant may submit a maximum of 3,000 entries per Round, including free entries submitted via the Alternate Method of Entry (AMOE) and any entries earned through merchandise purchases or “fast entry” purchases.
6.G.ii. Any entries received beyond the maximum will be void and will not increase a participant’s chances of winning.
6.G.iii. Sponsor reserves the right to verify, limit, or refuse any entries to ensure the fairness, security, and integrity of the Promotion.
6.G.iv. Entries submitted under multiple accounts, identities, devices, or email addresses by a single participant will be aggregated and counted toward the maximum per Round. Any attempt to circumvent the entry limit may result in disqualification of all entries and forfeiture of prizes.
7. WINNER SELECTION
7.A. One (1) potential winner will be selected by random drawing from all eligible entries received during the applicable Round.
7.B. Winner selection may be conducted using automated or software-assisted systems.
7.C. Odds of winning depend on the total number of eligible entries received.
7.D. Sponsor’s decisions regarding winner selection are final and binding.
8. WINNER NOTIFICATION
8.A. Potential winners will be notified by email within five (5) business days following the drawing.
8.B. Winners must respond to the notification within seven (7) calendar days.
8.C. Failure to timely respond, failure to provide required information, or failure to comply with these Official Rules may result in forfeiture of the prize.
8.D. Sponsor may require winners to complete, sign, and return required documentation as a condition of prize award.
8.E. In the event of forfeiture, Sponsor reserves the right to select an alternate winner.
8.F. Electronic Verification and Documentation: Required winner documentation, including affidavits, eligibility verification forms, and releases, may be completed and submitted electronically or in paper form, at Sponsor’s discretion. Electronic submissions shall have the same legal effect as original signed documents.
9. PRIZE DESCRIPTION AND FAIR MARKET VALUE (FMV)
9.A. Each Round features a designated vehicle with a disclosed Fair Market Value (“FMV”).
9.B. The FMV will be displayed on Sponsor’s website prior to the start of the applicable Round.
9.C. FMV is determined in good faith using nationally recognized valuation sources, which may include:
9.C.i. Kelley Blue Book (KBB)
9.C.ii. NADA Guides / J.D. Power
9.C.iii. Edmunds or similar valuation services
9.C.iv. Dealership pricing or invoice documentation
9.D. Sponsor’s FMV determination is final and binding.
10. GRAND PRIZE AND AWARD STRUCTURE
10.A. Winner Selection Guarantee
10.A.i. One (1) prize winner will be selected by random drawing for each Round, regardless of whether the advertised vehicle is awarded.
10.B. Conditional Award of Advertised Vehicle
10.B.i. The advertised vehicle may be awarded only if Net Promotional Proceeds generated during the applicable Round meet or exceed the amount required to cover the vehicle’s FMV and associated promotional and administrative costs, as determined by Sponsor in its sole discretion.
10.B.ii. Sponsor is not required to allocate any specific portion of revenue toward prizes.
10.C. Definition of Net Promotional Proceeds
10.C.i. “Net Promotional Proceeds” means gross revenue generated in connection with the Promotion minus costs incurred by Sponsor, including but not limited to:
10.C.i.a. Product manufacturing and sourcing
10.C.i.b. Fulfillment and shipping
10.C.i.c. Taxes and governmental fees
10.C.i.d. Payment processing and platform fees
10.C.i.e. Marketing, advertising, and promotional expenses
10.C.i.f. Operational, administrative, and compliance costs
10.C.ii. Sponsor’s calculation of Net Promotional Proceeds is final and binding.
10.D. Award Options When Vehicle Is Awarded
10.D.i. If Sponsor determines the Net Promotional Proceeds requirement has been satisfied, the selected winner may choose either:
10.D.i.a. The advertised vehicle; or
10.D.i.b. A cash prize equal to the vehicle’s FMV, as determined by Sponsor.
10.E. Cash Prize When Vehicle Is Not Awarded
10.E.i. If Sponsor determines the Net Promotional Proceeds requirement has not been satisfied, or if the designated vehicle is damaged, destroyed, or otherwise unavailable for any reason, the advertised vehicle will not be awarded.
10.E.ii. In such case, the selected winner will receive a cash prize determined by Sponsor in its sole discretion. The cash prize may be calculated using a fixed amount, a percentage of Net Promotional Proceeds, or another method selected by Sponsor.
10.E.iii. No minimum cash prize is guaranteed unless expressly stated in advance.
10.E.iv. All decisions regarding vehicle unavailability, damage, or cash substitution are final, binding, and within the sole discretion of Sponsor.
10.F. Additional Conditions
10.F.i. The advertised vehicle is not guaranteed to be awarded in every Round.
10.F.ii. In all cases, one (1) prize will be awarded per Round.
10.F.iii. All prizes are subject to eligibility verification and compliance with these Official Rules.
10.F.iv. Winners are responsible for all applicable taxes, fees, and expenses not expressly stated as part of the prize.
10.G. No funds received by Sponsor in connection with the Promotion are held in escrow, trust, or fiduciary capacity for entrants or winners unless expressly required by applicable law.
11. TAXES AND REQUIRED DOCUMENTATION
11.A. Winners are solely responsible for all applicable federal, state, and local taxes associated with receipt of a prize.
11.B. Sponsor may require winners to complete, sign, and return required documentation, which may include but is not limited to:
11.B.i. IRS Form W-9
11.B.ii. IRS Form 1099 or equivalent tax reporting documentation
11.B.iii. Affidavit of Eligibility
11.B.iv. Liability and Publicity Release
11.C. Required documentation must be completed, signed, and returned within the timeframe specified by Sponsor.
11.D. Failure to timely complete, sign, or return any required documentation, or failure to comply with these Official Rules, may result in forfeiture of the prize.
11.E. In the event of forfeiture, Sponsor reserves the right to select an alternate winner in accordance with these Official Rules.
11.F. IRS Reporting and Tax Disclosure: For prizes with a fair market value of $600 or more, Sponsor may report the prize value to the Internal Revenue Service (IRS) or other applicable tax authorities in accordance with U.S. tax law. Winners are responsible for all tax obligations associated with their prize.
12. VEHICLE DELIVERY AND EXPENSES
12.A. Sponsor will arrange delivery of the vehicle at no cost to the winner.
12.B. Vehicle delivery is limited to Eligible Jurisdictions.
12.C. The winner is responsible for title, registration, insurance, and all ongoing ownership, licensing, and maintenance expenses.
12.D. Publicity and Promotional Opt-Out: Winners may request to opt out of publicity, advertising, or promotional media coverage. Such a request must be communicated in writing to Sponsor within seven (7) calendar days of prize notification. Sponsor may still use prize details (excluding name, likeness, or statements) in aggregate reporting or marketing summaries.
13. VEHICLE CONDITION DISCLAIMER
13.A. Vehicles are awarded “AS IS, WHERE IS.”
13.B. Sponsor makes no warranties, express or implied, including warranties of merchantability or fitness for a particular purpose.
13.C. Vehicle mileage may increase due to transportation, testing, inspection, or maintenance prior to delivery.
14. PUBLICITY RELEASE
14.A. Except where prohibited by law, acceptance of a prize constitutes the winner’s consent for Sponsor to use the winner’s name, city, likeness, voice, and statements for advertising, promotional, and publicity purposes, in any media now known or hereafter developed, without additional compensation.
15. PRIVACY
15.A. Participant information is used to administer the Promotion.
15.B. Data handling practices are governed by Sponsor’s Privacy Policy, which is incorporated by reference and forms part of these Official Rules.
16. DISQUALIFICATION
16.A. Sponsor reserves the right to disqualify any participant who violates these Official Rules.
16.B. Sponsor reserves the right to disqualify any participant who attempts to tamper with, abuse, or undermine the Promotion, Website, entry process, or winner selection process.
17. LIMITATION OF LIABILITY
17.A. To the fullest extent permitted by law, Sponsor shall not be liable for indirect, incidental, special, consequential, or punitive damages.
17.B. Sponsor’s total liability shall not exceed the amount paid by the participant, if any, during the applicable Round.
17.C. Insurance and Liability Alignment
17.C.i. Entrants acknowledge and agree that Sponsor’s liability under these Official Rules is limited to the fullest extent permitted by applicable law, regardless of whether Sponsor maintains any insurance coverage related to the Promotion.
17.C.ii. Nothing in these Official Rules shall be construed as an admission of liability, a waiver of any defenses, or a representation that insurance coverage exists or applies to any claim.
17.C.iii. The existence, scope, or availability of insurance coverage, if any, shall not increase Sponsor’s liability beyond the limitations expressly set forth in these Official Rules.
17.C.iv. All claims arising out of or related to the Promotion shall be subject to the liability limitations, exclusions, and conditions stated herein, irrespective of insurance considerations.
17.C.v. This Section survives the conclusion, cancellation, or completion of any Round and the awarding of any prize.
17.D. Chargebacks, payment disputes, reversals, or refunded transactions do not affect entry eligibility, winner selection, or prize outcomes and do not increase Sponsor’s liability.
18. CANCELLATION OR MODIFICATION
18.A. Sponsor reserves the right to cancel, suspend, modify, or terminate the Promotion or any Round if fraud, technical failures, administrative errors, regulatory issues, or any other factor beyond Sponsor’s reasonable control compromises the integrity, fairness, or lawful operation of the Promotion.
18.B. In the event of cancellation, Sponsor may, in its sole discretion and where permitted by law, select a winner from all eligible, non-suspect entries received prior to cancellation.
19. GOVERNING LAW AND VENUE
19.A. These Official Rules are governed by and construed in accordance with the laws of the State of Wisconsin, without regard to conflict of law principles.
19.B. All disputes, claims, or causes of action arising out of or relating to the Promotion shall be resolved exclusively in the state or federal courts located within the State of Wisconsin.
20. RECORDS AND COMPLIANCE
20.A. Sponsor maintains records for each Round, including but not limited to:
20.A.i. Entry totals
20.A.ii. Fair Market Value determinations
20.A.iii. Net Promotional Proceeds calculations
20.A.iv. Winner selection documentation
20.A.v. Compliance, audit, and verification records
20.B. Sponsor’s records shall be deemed final and binding in all matters relating to the Promotion, to the fullest extent permitted by law.
21. ENTRY VERIFICATION AND AUDIT RIGHTS
21.A. Sponsor reserves the right to verify the eligibility, identity, and compliance of any entrant or potential winner at any time.
21.B. Sponsor may review, audit, investigate, or invalidate entries, accounts, submissions, and related records to ensure compliance with these Official Rules.
21.C. Sponsor may disqualify any entry or entrant that Sponsor determines, in its sole discretion, does not comply with these Official Rules.
21.D. Sponsor’s verification, audit, and enforcement determinations are final and binding.
22. FRAUD PREVENTION AND ANTI-CIRCUMVENTION
22.A. Sponsor reserves the right to disqualify any participant who attempts to:
22.A.i. Circumvent entry limits
22.A.ii. Submit entries using multiple identities, accounts, devices, or email addresses
22.A.iii. Use automated systems, bots, scripts, scraping tools, or unauthorized methods
22.A.iv. Manipulate, interfere with, or undermine the Promotion or its operation
22.B. Any attempt to undermine the legitimate operation of the Promotion may result in disqualification, forfeiture of prizes, and, where applicable, legal action.
23. TECHNICAL FAILURES AND FORCE MAJEURE
23.A. Sponsor is not responsible for entries that are lost, late, misdirected, corrupted, incomplete, or otherwise invalid due to technical failures.
23.B. Sponsor is not responsible for website downtime, server errors, transmission failures, or other technical malfunctions.
23.C. Sponsor is not responsible for delays or failures caused by events beyond Sponsor’s reasonable control, including acts of God, natural disasters, governmental actions, labor disputes, power failures, or internet outages.
24. THIRD-PARTY PLATFORM DISCLAIMER
24.A. The Promotion may utilize third-party platforms, services, software, or vendors for website hosting, entry processing, payment processing, communications, analytics, or compliance functions.
24.B. Sponsor is not responsible for the acts, omissions, failures, interruptions, or errors of any third-party service provider.
24.C. Use of third-party platforms is subject to their respective terms, conditions, and policies.
25. COMPLIANCE MODIFICATION AUTHORITY
25.A. Sponsor reserves the right to interpret, modify, clarify, or supplement these Official Rules to address administrative issues, ambiguities, technical errors, or compliance requirements.
25.B. Any such modification shall be applied in a manner intended to preserve the integrity, intent, and lawful operation of the Promotion.
25.C. Material changes, if required, will be communicated in accordance with applicable law.
26. SEVERABILITY
26.A. If any provision of these Official Rules is determined to be invalid, illegal, or unenforceable, such provision shall be severed.
26.B. The remaining provisions shall remain in full force and effect
27. INSURANCE ALIGNMENT AND RISK ALLOCATION
27.A. Sponsor may, but is not required to, maintain commercial general liability, product liability, cyber liability, errors and omissions, or other insurance coverage in connection with its business operations, promotions, merchandise, or sweepstakes activities.
27.B. The existence, absence, scope, limits, exclusions, or availability of any insurance coverage maintained by Sponsor shall not expand, modify, or increase Sponsor’s liability or obligations beyond those expressly stated in these Official Rules.
27.C. Entrants acknowledge and agree that insurance coverage, if any, is maintained solely for Sponsor’s internal risk management purposes and not for the benefit of any entrant, participant, purchaser, or third party.
27.D. No entrant shall be deemed a third-party beneficiary of any insurance policy maintained by Sponsor.
27.E. Insurance and Liability Alignment: Sponsor may, but is not required to, maintain any insurance coverage, including without limitation general liability, product liability, cyber liability, errors and omissions, or other commercial insurance. The existence, absence, type, scope, limits, or exclusions of any insurance coverage shall not expand, increase, modify, or create any additional liability, obligation, or right of any entrant, participant, user, or third party under these Official Rules, Privacy Policy, Terms & Conditions, or any related promotional materials. No entrant, participant, or user is a third-party beneficiary of any insurance maintained by Sponsor. This clause survives the conclusion, cancellation, or completion of any promotion, sweepstakes, prize award, or website use and applies equally to all claims arising under, or relating to, these documents.
28. LIMITATION OF REMEDIES
28.A. Entrants’ sole and exclusive remedy for any claim arising out of or relating to the Sweepstakes shall be limited to actual out-of-pocket costs incurred to enter, not to exceed the value of one (1) merchandise item, if applicable.
28.B. In no event shall entrants be entitled to recover attorneys’ fees, expert fees, punitive damages, exemplary damages, incidental damages, or consequential damages.
29. NO WAIVER
29.A. Sponsor’s failure to enforce any provision of these Official Rules shall not constitute a waiver of that provision or any other provision.
29.B. Any waiver must be expressly stated in writing and signed by Sponsor.
30. INTERPRETATION
30.A. Sponsor shall have the sole discretion to interpret and apply these Official Rules.
30.B. Sponsor’s decisions regarding interpretation, administration, and enforcement of the Sweepstakes shall be final and binding.
31. HEADINGS
31.A. Headings are included for convenience only and shall not affect the interpretation of these Official Rules.
32. COMPLIANCE STATEMENT
32.A. The Sweepstakes is intended to comply with all applicable federal, state, and local laws and regulations.
32.B. The Sweepstakes is void where prohibited or restricted by law.
32.C. Age and Parental Consent: By participating in the Promotion, entrants affirm they meet the minimum age requirement. If an entrant is under the age of majority in their jurisdiction, parental or guardian consent is required. Sponsor does not knowingly collect personal information from minors.
33. REGULATORY AND BANKING REVIEW ACKNOWLEDGMENT
33.A. Entrants acknowledge that Sponsor may be subject to review by banks, payment processors, insurers, regulators, auditors, or other third parties.
33.B. Sponsor’s compliance with such reviews does not create any rights or remedies for entrants beyond those expressly stated in these Official Rules.
34. FINALITY OF OFFICIAL RULES
34.A. These Official Rules constitute the entire agreement between Sponsor and entrants regarding the Sweepstakes.
34.B. No oral statements, marketing materials, advertisements, or other representations shall modify or supersede these Official Rules.
34.C. Version 1.0 of these Official Rules is hereby designated as the official, controlling, and final version unless amended by Sponsor in writing.
35. COMPLIANCE WITH ONLINE CONDUCT LAWS
35.A. Participants agree to comply with all applicable federal, state, and local laws regarding online conduct, including but not limited to anti-spam, anti-fraud, and anti-hacking statutes.
35.B. Any attempt to circumvent, manipulate, or exploit the Promotion in violation of law may result in disqualification, forfeiture of prizes, and potential civil or criminal liability.
36. MONITORING AND RECORDING
36.A. Sponsor may monitor, record, and retain communications, entries, and other activity related to the Promotion for compliance, auditing, fraud prevention, or legal purposes.
36.B. Participants consent to such monitoring and recordkeeping as a condition of participation.
37. NO IMPLIED ENDORSEMENTS
37.A. Participation in the Promotion does not constitute an endorsement, sponsorship, or affiliation with any Sponsor partner, affiliate, or third party, except as expressly stated in the Official Rules.
38. GOVERNMENTAL REGULATORY DISCLAIMER
38.A. Sponsor may be subject to review, audit, or oversight by governmental, regulatory, or banking authorities.
38.B. Entrants acknowledge that compliance with such oversight does not create any claim, right, or remedy against Sponsor beyond what is expressly provided in these Official Rules.
