1. ACCEPTANCE OF TERMS
1.A. These Terms & Conditions (“Terms”) govern access to and use of the Website, including all content, features, products, services, communications, and related offerings.
1.B. By accessing, browsing, purchasing from, or otherwise using the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1.C. If you do not agree to these Terms, you must immediately discontinue use of the Website.
1.D. These Terms apply to all visitors, users, customers, purchasers, and participants, without limitation.
2. RELATIONSHIP TO OFFICIAL RULES
2.A. Participation in any sweepstakes, giveaway, or promotion offered by Sponsor is governed exclusively by the applicable Official Rules.
2.B. In the event of any conflict between these Terms and the Official Rules, the Official Rules shall control with respect to all sweepstakes-related matters.
2.C. These Terms govern Website access, merchandise purchases, communications, and all non-sweepstakes-related interactions with Sponsor.
3. ELIGIBILITY TO USE WEBSITE
3.A. You must be at least eighteen (18) years of age or the age of majority in your jurisdiction of residence, whichever is greater, to use the Website.
3.B. By using the Website, you represent and warrant that you meet the eligibility requirements set forth herein.
3.C. Use of the Website is void where prohibited by law.
4. MERCHANDISE SALES
4.A. Sponsor offers merchandise for sale through the Website.
4.B. Merchandise may be available for purchase in all fifty (50) United States, subject to availability and applicable law.
4.C. Merchandise descriptions, images, availability, pricing, and specifications are subject to change at any time without notice.
4.D. All prices are listed in United States dollars (USD).
4.E. Sponsor reserves the right to correct pricing errors, inaccuracies, or omissions and to cancel or refuse any order arising from such errors.
4.F. Returns, Cancellations, and Refunds: Merchandise may be returned, canceled, or refunded in accordance with Sponsor’s posted return policy. Returned, canceled, refunded, disputed, or chargeback transactions may void any associated sweepstakes entries or promotional benefits.
5. SWEEPSTAKES ENTRIES VIA PURCHASES
5.A. Certain merchandise purchases may generate sweepstakes entries only as expressly described in the applicable Official Rules.
5.B. Sweepstakes entry eligibility is limited to residents of Eligible Jurisdictions as defined in the Official Rules.
5.C. Purchases originating from non-eligible jurisdictions do not generate sweepstakes entries and do not fund prizes.
5.D. Merchandise purchases do not constitute gambling, wagering, investment activity, equity, ownership interest, or profit-sharing arrangement.
5.E. Returned, refunded, canceled, disputed, or chargeback transactions do not generate and will void any associated sweepstakes entries.
5.F. Free Entries / Alternate Method of Entry (AMOE)
5.F.i. No purchase is necessary to enter or win.
5.F.ii. Free entries are subject to the same weekly limits, eligibility requirements, and odds of winning as set forth in the Official Rules.
5.F.iii. Automated, duplicate, incomplete, inaccurate, or fraudulent entries are void.
5.G. Forfeiture and Abandonment
5.G.i. Any entries, benefits, prizes, or promotional considerations not timely claimed, verified, or accepted in accordance with the applicable Official Rules shall be deemed forfeited.
5.G.ii. Forfeited or abandoned entries or benefits may be disposed of at Sponsor’s sole discretion, without compensation or liability.
5.H. No Prize Expectation: Participation in any Promotion does not create an expectation or entitlement to receive a prize. All prizes are awarded solely according to the Official Rules and Sponsor’s verification processes.
5.I. Maximum Entries Per Round
5.I.i. Each participant may submit a maximum of 3,000 entries per Round, including free entries submitted via the Alternate Method of Entry (AMOE) and any entries earned through merchandise purchases or “fast entry” purchases.
5.I.ii. Any entries received beyond the maximum will be void and will not increase a participant’s chances of winning.
5.I.iii. Sponsor reserves the right to verify, limit, or refuse any entries to ensure the fairness, security, and integrity of the Promotion.
5.I.iv. Entries submitted under multiple accounts, identities, or devices by a single participant will be aggregated and counted toward the maximum per Round. Any attempt to circumvent the entry limit may result in disqualification of all entries and forfeiture of prizes.
6. PAYMENTS AND BILLING
6.A. All payments are processed through third-party payment processors.
6.B. Sponsor does not store full payment card numbers or sensitive financial information.
6.C. Payment processing is subject to the terms, conditions, and privacy policies of the applicable third-party processor.
6.D. You agree to provide accurate, current, and complete billing, shipping, and purchase information.
7. PROHIBITED CONDUCT
7.A. Users may not engage in conduct that Sponsor determines, in its sole discretion, to be unlawful, fraudulent, abusive, manipulative, deceptive, or harmful.
7.A.i. Submitting false, misleading, or inaccurate information
7.A.ii. Attempting to manipulate sweepstakes entries, funding, odds, or outcomes
7.A.iii. Using automated systems, bots, scripts, scraping tools, or similar methods
7.A.iv. Interfering with Website functionality, security, or integrity
7.A.v. Violating applicable laws, regulations, or third-party rights
7.B. Sponsor reserves the right to investigate violations and suspend or permanently terminate access without notice.
7.C. Regulatory Compliance Authority
7.C.i. Users acknowledge that sweepstakes, promotions, and online commerce activities are subject to evolving legal and regulatory requirements.
7.C.ii. Sponsor may modify, suspend, restrict, or terminate any Website feature, promotion, or participation right as necessary to comply with applicable law, regulation, regulatory guidance, or enforcement action, without liability.
8. INTELLECTUAL PROPERTY
8.A. All Website content is owned by or licensed to Sponsor and is protected by intellectual property laws.
8.B. This includes, without limitation, trademarks, logos, text, images, designs, videos, layouts, and software.
8.C. Unauthorized use, reproduction, modification, distribution, or exploitation is prohibited.
9. USER SUBMISSIONS AND CONTENT
9.A. Any content, feedback, reviews, images, or materials submitted by users (“Submissions”) are provided voluntarily.
9.B. By submitting Submissions, users grant Sponsor a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use such Submissions for lawful business purposes.
9.C. Users represent and warrant that they own or have the necessary rights to submit such Submissions.
9.D. Sponsor reserves the right to review, remove, refuse, or restrict any Submissions at its sole discretion.
10. THIRD-PARTY LINKS AND SERVICES
10.A. The Website may contain links to third-party websites, platforms, or services.
10.B. Sponsor does not control, endorse, or assume responsibility for third-party content, practices, or availability.
10.C. Accessing third-party services is at the user’s sole risk.
11. DISCLAIMER OF WARRANTIES
11.A. The Website, products, and services are provided “AS IS” and “AS AVAILABLE.”
11.B. Sponsor disclaims all warranties, express or implied.
11.C. This includes warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
12. LIMITATION OF LIABILITY
12.A. To the fullest extent permitted by law, Sponsor shall not be liable for indirect, incidental, special, consequential, or punitive damages.
12.B. Sponsor’s total liability shall not exceed the amount paid by the user to Sponsor, if any.
12.B.i. Insurance and Liability Alignment: Sponsor may, but is not required to, maintain any insurance coverage, including without limitation general liability, product liability, cyber liability, errors and omissions, or other commercial insurance. The existence, absence, type, scope, limits, or exclusions of any insurance coverage shall not expand, increase, modify, or create any additional liability, obligation, or right of any entrant, participant, user, or third party under these Official Rules, Privacy Policy, Terms & Conditions, or any related promotional materials. No entrant, participant, or user is a third-party beneficiary of any insurance maintained by Sponsor. This clause survives the conclusion, cancellation, or completion of any promotion, sweepstakes, prize award, or website use and applies equally to all claims arising under, or relating to, these documents.
12.C. No Expectation of Prize
12.C.i. Users acknowledge and agree that participation in any promotion does not create any expectation, entitlement, or right to receive a prize.
12.C.ii. No prize is guaranteed unless and until all conditions set forth in the applicable Official Rules are fully satisfied and verified by Sponsor in its sole discretion.
13. RELEASE, ASSUMPTION OF RISK, AND INDEMNIFICATION
13.A. Users release Sponsor from claims arising out of Website use, purchases, Submissions, communications, or reliance on content.
13.B. Users voluntarily assume all risks associated with Website use and merchandise purchase or use.
13.C. Users agree to indemnify and hold harmless Sponsor from claims arising from violation of these Terms or applicable law.
13.D. Nothing herein waives rights that cannot legally be waived.
14. ARBITRATION AND CLASS ACTION WAIVER
14.A. Disputes shall be resolved by binding arbitration, except where prohibited by law.
14.B. Arbitration shall be conducted on an individual basis only.
14.C. Users waive any right to jury trial or class action participation.
15. TERMINATION
15.A. Sponsor reserves the right to suspend or terminate Website access at any time, with or without notice, for any reason.
15.B. Good-Faith Interpretation
15.B.i. All interpretations, determinations, and decisions made by Sponsor under these Terms and any applicable Official Rules shall be made in good faith.
15.B.ii. Such interpretations and determinations shall be final and binding to the fullest extent permitted by law.
16. PRIVACY
16.A. Use of the Website is governed by Sponsor’s Privacy Policy, which is incorporated by reference.
17. ELECTRONIC COMMUNICATIONS
17.A. Users consent to receive electronic communications from Sponsor.
17.B. Electronic communications satisfy any legal writing requirement.
17.C. Electronic Signatures: Users consent to the use of electronic signatures, forms, or agreements for any required documentation, verification, or legal compliance in connection with merchandise purchases or Promotions.
18. NO PROFESSIONAL ADVICE
18.A. Website content is for informational purposes only.
18.B. Nothing constitutes legal, tax, financial, or professional advice.
19. FORCE MAJEURE
19.A. Sponsor is not liable for delays or failures caused by events beyond reasonable control.
20. ASSIGNMENT AND SEVERABILITY
20.A. Sponsor may assign these Terms without restriction.
20.B. Invalid provisions shall be severed without affecting remaining provisions.
20.C. No Waiver
20.C.i. Sponsor’s failure to enforce any provision of these Terms shall not constitute a waiver of such provision or of Sponsor’s right to enforce such provision in the future.
20.D. Age and Parental Consent: Users represent that they meet the minimum age requirement to participate in Promotions. If under the age of majority in their jurisdiction, participation requires parental or guardian consent.
21. GOVERNING LAW AND VENUE
21.A. Governed by the laws of the State of Wisconsin.
21.B. Venue lies exclusively in Wisconsin state or federal courts.
22. CHANGES TO TERMS
22.A. Sponsor may modify these Terms at any time.
22.B. Continued use constitutes acceptance of updated Terms.
23. NON-RELIANCE AND PROMOTIONAL INTERPRETATION
23.A. Users acknowledge and agree that they have not relied upon any representations, statements, marketing materials, advertisements, social media posts, or promotional content other than those expressly set forth in these Terms and the applicable Official Rules.
23.B. No oral statements, illustrations, examples, estimates, projections, or promotional descriptions shall modify or supplement these Terms or the Official Rules.
23.C. Any ambiguity shall be interpreted in a manner consistent with lawful operation of the Website and Promotions.
24. NO FIDUCIARY, TRUST, OR ESCROW RELATIONSHIP
24.A. No fiduciary, agency, partnership, joint venture, trust, escrow, or special relationship is created between Sponsor and any user.
24.B. Sponsor does not hold funds in trust for users and does not act as a custodian, trustee, or financial intermediary.
25. STATUTE OF LIMITATIONS
25.A. To the fullest extent permitted by law, any claim or cause of action arising out of or related to the Website, merchandise purchases, Promotions, Official Rules, or these Terms must be filed within one (1) year after such claim or cause of action arises.
25.B. Claims filed after this period are permanently barred.
26. EQUITABLE RELIEF LIMITATION
26.A. Users agree that any claim shall be limited to monetary damages as expressly permitted herein.
26.B. Users waive any right to seek injunctive, equitable, or extraordinary relief that would interfere with Sponsor’s business operations, Promotions, or Website availability.
27. FRAUD PREVENTION, MONITORING, AND DATA ANALYSIS CONSENT
27.A. Users consent to Sponsor’s use of fraud prevention, security, monitoring, analytics, and compliance tools.
27.B. This may include IP address analysis, device fingerprinting, behavioral analysis, entry pattern review, and account de-duplication.
27.C. Sponsor may treat multiple accounts, identities, devices, or entries as belonging to a single user when fraud, abuse, or circumvention is suspected.
28. AUDIT, RECORDKEEPING, AND LOG RETENTION
28.A. Sponsor reserves the right to maintain records, logs, audit trails, and transactional data for compliance, fraud prevention, dispute resolution, and legal defense purposes.
28.B. Such records may be retained for the maximum period permitted by applicable law.
29. CHARGEBACK AND PAYMENT ABUSE
29.A. Sponsor reserves the right to suspend, restrict, or permanently ban users who engage in excessive, abusive, or bad-faith chargebacks or payment disputes.
29.B. Chargeback abuse may result in voided sweepstakes entries and forfeiture of promotional eligibility.
30. SANCTIONS, EXPORT, AND LEGAL COMPLIANCE
30.A. Users represent that they are not subject to economic sanctions, embargoes, or restricted party lists administered by the United States government.
30.B. Users agree not to use the Website in violation of export control, sanctions, or trade compliance laws.
31. REGULATORY INTERPRETATION AUTHORITY
31.A. Sponsor reserves the right to interpret and apply these Terms and the Official Rules in a manner consistent with applicable law and regulatory guidance.
31.B. Sponsor’s good-faith interpretations shall control unless prohibited by law.
32. EMERGENCY PRIZE SUBSTITUTION AUTHORITY
32.A. If a prize becomes unavailable, damaged, destroyed, illegal, impracticable, or impossible to award due to regulatory action, title issues, force majeure, or circumstances beyond Sponsor’s control, Sponsor reserves the right to substitute a prize of equal or greater value, including a cash prize in lieu of a vehicle, consistent with applicable law and the Official Rules.
32.B. Notwithstanding Section 32.A, the conditional award of any vehicle prize, including determination of Net Promotional Proceeds and eligibility, is governed exclusively by the Official Rules.
32.C. Any substitution, modification, or forfeiture of a prize will be conducted in accordance with the Official Rules and applicable law.
32.D. State and Regulatory Compliance: Sponsor reserves the right to modify or suspend any Website feature, Promotion, or prize to comply with federal, state, or local regulations, registration requirements, or enforcement actions without liability.
33. CLASS ACTION WAIVER SURVIVAL
33.A. The class action waiver and arbitration provisions survive termination of Website access, completion of transactions, and conclusion of Promotions.
34. HEADINGS AND CONSTRUCTION
34.A. Section headings are for convenience only and shall not affect interpretation.
34.B. These Terms shall not be construed against Sponsor based on authorship.
35. ENTIRE AGREEMENT CONFIRMATION
35.A. These Terms, together with the Official Rules and Privacy Policy, constitute the complete and exclusive agreement between Sponsor and users.
35.B. No other representations or agreements shall have any force or effect.
36. ACCEPTABLE USE POLICY
36.A. Users may not use the Website for any purpose that Sponsor reasonably determines to be unlawful, abusive, harmful, or disruptive, including without limitation:
36.A.i. Uploading, transmitting, or distributing malware, viruses, or harmful code
36.A.ii. Attempting unauthorized access to the Website, servers, or accounts
36.A.iii. Scraping, automated data collection, or excessive requests that degrade service
36.B. Violation of this Section may result in suspension, termination, or legal action.
37. USER ACCOUNT SECURITY
37.A. Users are solely responsible for maintaining the confidentiality of account credentials.
37.B. Users agree to promptly notify Sponsor of any unauthorized access, use, or security breach related to their account.
37.C. Sponsor is not liable for losses arising from unauthorized use of accounts due to user negligence.
38. LINKS TO THIRD-PARTY SERVICES
38.A. The Website may include links to third-party websites, services, or applications.
38.B. Sponsor is not responsible for third-party content, policies, practices, or availability.
38.C. Users access third-party services at their own risk and agree that Sponsor shall have no liability for third-party actions.
39. CONTINUITY OF PROMOTIONS
39.A. If any feature of a Promotion changes, becomes unavailable, or is modified due to regulatory, technical, or operational reasons, participant rights remain subject to the Official Rules and Sponsor’s discretion.
39.B. Sponsor’s determination of promotional continuity and eligibility shall be final and binding.
